Terms of Service

1. Acceptance of Terms

By accessing and using CreonOS ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms of Service, please do not use the Service.

2. Description of Service

CreonOS is an AI agent platform that provides:

• An AI agent that builds websites and software in a workspace of real files, and checks its own work before it says it is done
• An optional Multi mode that splits a bigger job across several agents
• A sandboxed terminal and git in that workspace
• Publishing of pages to a link you can share

3. User Accounts

3.1 Account Creation

To access certain features of CreonOS, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your password and account
• Accept all responsibility for activity under your account
• Notify us immediately of any unauthorized use

3.2 Account Termination

We reserve the right to suspend or terminate your account if:

• You violate these Terms of Service
• You engage in fraudulent or illegal activities
• Your actions could harm other users or the Service
• Your account has been inactive for an extended period

If you break section 4.3, we can suspend or close your account straight away, without notice, and cancel any trial or subscription.

4. Acceptable Use Policy

4.1 Permitted Uses

You may use CreonOS for:

• Software development and code generation
• AI-assisted programming and automation
• Educational and research purposes
• Commercial software development projects
• Personal productivity and learning

4.2 Prohibited Uses

You agree NOT to:

• Generate malicious code, viruses, or malware
• Attempt to breach security measures or access unauthorized data
• Reverse engineer, decompile, or disassemble the Service
• Use the Service to infringe intellectual property rights
• Overload or disrupt the Service infrastructure
• Create fake accounts or impersonate others
• Scrape or harvest data without permission
• Use the Service for illegal activities

4.3 Sexual Content

CreonOS is for building businesses. You agree NOT to use it to:

• Make, upload or ask for sexually explicit material, including nude or sexual images and videos
• Build adult, pornographic or escort websites
• Make nude, sexual or intimate images of a real person, or edit a real person's photo to look that way, whether or not they agree
• Make, upload or ask for anything that sexualises children. We will report it to the relevant authorities

This applies to AI-generated and made-up people as well as real ones. Our systems refuse sexual image and video requests, and we may review and suspend any account that breaks this section.

5. Intellectual Property

5.1 Your Content

You retain all rights to code and content you create using CreonOS. By using the Service, you grant us a limited license to:

• Store and process your code for service delivery
• Use anonymized data to improve our AI models
• Display your content within the platform

5.2 AI-Generated Code

Code generated by CreonOS's AI agents is licensed to you under the MIT License, allowing commercial use. However, you are solely responsible for:

• Reviewing generated code for quality and security
• Ensuring compliance with applicable laws
• Testing before production deployment

6. Privacy and Data

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your data. By using CreonOS, you consent to our data practices as described in the Privacy Policy.

If you allow session recording, we record how you use the app in the way our Privacy Policy describes. You choose whether to allow it, you can turn it off at any time under Settings, then Account, and turning it off does not change what you can do with CreonOS. Recordings are deleted after 30 days. A recording is not a copy of your work and is not a backup: what you type is deliberately masked out of it, so it cannot be used to recover anything you wrote.

6.1 Your Customers' Data (Data Processing Terms)

If your published site collects enquiries, bookings, orders or sign-ups, the people who send them are your customers and you are the controller of their data. We are your processor, and these terms are your data processing agreement with us:

• We process that data only to store it, show it to you, email it to you, let you reply, export it and delete it, and otherwise only on your instruction. If you ask the agent to read or write about your customers in a conversation, that request is sent to the model provider for that conversation; nothing is sent by default.
• Our sub-processors are Amazon Web Services (storage and email, EU West 2) and, only when you ask as above, the AI model provider named in the product.
• We keep the data for 24 months unless you choose a shorter or longer period in your dashboard, then delete it. Closing your account deletes it. We protect it with encryption in transit and at rest, a second sign-in step to open the dashboard, and an audit record of every access.
• We will tell you within 72 hours of becoming aware of a breach that affects your customers' data, and we will help you answer their access and deletion requests.
• You are responsible for your own privacy notice, for having a lawful basis to collect what your form asks for, and for not asking for more than you need.

7. Payment Terms

7.1 Pricing

CreonOS offers multiple pricing tiers:

• Free Tier: Limited agent executions per month
• Paid Tiers (Pro, Ultra, Studio and Agency): A monthly credit allowance with a daily ceiling, as shown on the pricing page
• Enterprise: Custom deployments and SLAs

7.2 Billing

For paid plans:

• Billing is monthly, based on the plan you select
• Payments are processed securely via Stripe
• All fees are non-refundable except as required by law
• You can cancel anytime; access continues until period end

8. Service Availability

We strive for 99.9% uptime but cannot guarantee uninterrupted service. CreonOS is provided "as is" without warranties. We are not liable for:

• Service downtime or maintenance windows
• Data loss (maintain your own backups)
• Third-party AI provider outages (Claude, OpenAI, Google, DeepSeek)
• Internet connectivity issues

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• CreonOS is provided "AS IS" and "AS AVAILABLE"
• We make no warranties regarding accuracy, reliability, or fitness for purpose
• We are not liable for indirect, incidental, or consequential damages
• Our total liability shall not exceed the amount you paid in the past 12 months
• You use AI-generated code at your own risk

10. Governing Law

These Terms are governed by the laws of the United Kingdom, without regard to conflict of law principles. Exclusive jurisdiction lies with courts in England and Wales.
